I was hit by a truck. Well my car was. Basically to keep it short I am trying to get my car fixed when the insurance company of the truck says I have no claim that their driver isnt at fault.

Looking for some general advice.

Contact a property damage lawyer.

Unless you were injured, then contact a personal injury lawyer.

Also, get the accident report if the Police did one. That'll have the official opinion of who's at fault. If it's in your favor, present that to the opposing insurance company.

I was turning left at a four way intersection with two left turn lanes I was in the right turn lane a semi tanker truck is in the left turn lane and cannot make the turn and comes into my lane hitting me in the quarter panel as we are both moving through the intersection.

the truck driver claims he was stopped in the intersection and that I came out of my lane and ran into him. there is a witness who says the same story. The truck driver was talking to everyone me the witness he was really strangely talkative and he told me the witness husband is a truck driver. truck driver kept apologizing saying he didnt know the area that he should not have been in the lane that he had to turn out and that other cars saw him turning wide and thought I did too.

there is a police report that states both of us failed to maintain our lanes. I guess based on our side of it. neither of us were cited.

dang, sounds bad. Not to scare you, obviously, but a lying witness is still a witness to those who dont know better.

There has to be a way to analyze the damage to determine whether it was from him hitting you or you hitting him (as they said).

See if there are any independent accident investigators around your arra and maybe they'll write a report saying based upon the angle of the dent, pattern of paint transfer, etc., that the accident likely happened a certain way. Might cost a few bucks, but I imagine small claims court would repay it to you or even the driver's insurance company - particularly if it shows he lied. Filing an intentionally false police report is a big deal too, and the witness will get in trouble.

that a good point the dent is just what you would expect if hit from the side there is no scraping on either side of the dent which in my mind would show I ran into him as he was stopped. also the commerical drivers handbook says truck drivers should always make a turn like that from the right lane to prevent having to leave the lane to go wide to make the turn.

If your house gets a plumbing issue and starts flooding your bathroom-baseement-crawlspace-whatever, you immediately shut down the water systems and call a plumber. You have an auto collision where the other parties (including the "witness", and I use that term loosely) are not acting in good faith. Stop everything and get a *good* lawyer immediately. You're getting abused by both insurance companies, the other driver, the witness, and the LEO(s), all of whom have an interest in letting you take a bath and absolve them of any further work or responsibility. You need a professional on your side, and you need them yesterday. Get the plumber to stop the disaster now. And most of all, good luck to you. You probably need this like you need another hole in the head.

Lawyer...its your only option to get anything out of the truck driver. Not a sure fire win at all though. You've got a lot going against you with the police report and witness. I wouldn't expect much...and you might end up losing money on the lawyer.

that is true. As a CDL holder myself, its dumb for him to have been in an inside lane. I would find a accident investigator and get a report from them. Short term cost, long term win
